This Privacy Policy is issued by Zaca Creek and covers information collected and used by the Hotel during its business. Your information may be collected and used by Zaca Creek through your use of this Site. Information you give us helps us best serve you during your stay with Zaca Creek. In your use of the Site, you may provide us with various information that personally identifies you. For example, we collect information from you when you make a booking through our reservation system or stay at Zaca Creek. Information collected during the course of the reservation and during your stay may include:
• Your name, email address, home and business address, phone number, nationality and payment card information; and
• Information such as stay and room preferences made during the course of your reservation such as your preferred room type and specific requests to the Zaca Creek.
This information may be provided to us directly when you make a reservation through our reservation system, through our website, or directly at Zaca Creek. In some cases, we may receive this information from a third party, such as when you book through an online travel agency or hotel booking site.
INFORMATION WE GET FROM YOUR USE OF THE SITE. We also collect information from you when you browse the Site or participate in certain services at Zaca Creek, such as wireless internet services. In these instances, information such as your country information, internet protocol (“IP”) address, media access control address and other characteristics about your system or device may be automatically collected. This information may be collected for functional purposes as well as to improve your experience when using these services. This information may also be used for aggregated trend and statistical analysis, and for showing you more relevant advertisements and messages. Prior to your stay, this may include sending your information to the Hotel or sending you pre-stay communications. Following your stay, we may also send you post-stay communications and satisfaction surveys to get feedback on your experience.
We may use this information for purposes of aggregated trend and statistical analysis to evaluate and improve our products and services, plan new hotel locations and services and other market research.
WHO WE SHARE YOUR INFORMATION WITH: We will use your information to to fulfill your reservation at Zaca Creek. We may also share your information with third party service providers to provide services in relation to our business as well as to help us improve our products and services. For example, we might use a third party or a third party product for the purposes of market research and data analytics. In certain instances, subject to local consent requirements, third party service providers may also assist us with various marketing campaigns.
Aside from the purposes described above, we do not share your stay information with any other third parties unless we have your consent or under special circumstances, such as:
• when we believe in good faith that the disclosure is required by law or to protect the safety of hotel guests, employees, the public or Hotel property;
• when disclosure is required to comply with a judicial proceeding, court order, subpoena, warrant or legal process; or
• in the event of a merger, asset sale, or other related transaction.
There may be other times when we collect and use personal information, for example if you choose to sign up to receive our newsletters or other special offers and promotions or participate in one of our other services. In these instances, we will collect information from you for running and administering the respective service that you have elected to participate in. The information collected may include personal details such as your name, address, and contact information, as well as certain demographic information. In each case, we will collect, use and secure your information in a manner consistent with the general principles set out in this Privacy Policy unless we tell you otherwise.

We may use various social media features such as the those utilized by Facebook, Instagram, or other third-party social media applications. Certain information may be shared or otherwise provided to us through your use of these features in conjunction with our services and programs. Subject to your account and privacy settings, we may also be able to see information that you post when using these social media platforms whether or not you are using one of our services. In some instances, depending on the circumstances, we may contact you on these social media platforms. The information you post on social media sites as well as the controls surrounding these disclosures are governed by the respective policies of these third parties.

Please note that in some instances it may not be possible to delete certain pieces of your information. In other instances, we may not have the ability to delete certain pieces of information that are stored on our systems or that have been provided to third parties in connection with the services discussed in this Privacy Policy.
SPECIAL INFORMATION FOR CALIFORNIA CONSUMERS
California residents may request a list of certain third parties to which we have disclosed personally identifiable information about you for their own direct marketing purposes. You may make one request per calendar year. In your request, please attest to the fact that you are a California resident and provide a current California address for your response. You may request this information in writing by contacting us through one of the methods listed on our website, either by phone or direct email. Please allow up to thirty (30) days for a response.

CHILDREN
Our website is not intended for children and we do not intentionally solicit or collect personal information from individuals under the age of 18. If we are notified or otherwise discover that a minor’s personal information has been improperly collected, we will take all commercially reasonable steps to delete that information.

Our property uses ResNexus to provide online reservation services.Privacy
ResNexus respects your privacy and is committed to protecting it. Your personal information is collected and stored to facilitate online reservations with our property. Basic information concerning your visit to this site is used by ResNexus to improve its service. Security
ResNexus uses industry-standard encryption to protect your personal and payment information during and after your reservation. After your reservation is complete, the system removes your credit card information to prevent theft or disclosure. ResNexus meets or exceeds rigorous industry standards for protecting credit card information and is PCI compliant. This PCI compliance has been verified by an external auditor.

RESNEXUS IS COMMITTED TO EASY ACCESS FOR EVERYONE
ResNexus is committed to making our online booking engine as accessible as possible to people with special needs, including those with visual, hearing, cognitive and motor impairments. We have invested a large amount of resources working towards improving the accessibility of the ResNexus online booking engine to ensure we provide equal access to all of our users.
To help us make the ResNexus online booking engine a positive experience for everyone, we’ve been using the web content accessibility guidelines (WCAG) 2.1. These guidelines explain how to make web content more accessible for people with disabilities, and user friendly for everyone.
In addition, we recommend that the property using the ResNexus online booking engine install the UserWay widget to provide the best user experience.
ADA ACCESSIBLE UNITS
As required by law for owner-occupied properties that have more than 5 units*, properties with 6 units or more should provide a unit that is reserved for customers with disabilities. The property should clearly identify these units and describe the accessible features in sufficient detail to reasonably permit individuals with disabilities to assess independently whether the given unit meets his or her accessibility needs. When selecting an ADA designated unit, if you do not have accessibility or other disability needs, please click cancel and select another unit unless it is the last unit available. If you do not meet the American with Disabilities Act (ADA) requirements for this unit and it is not the last unit available, the property reserves the right to change your reservation to another unit without your permission to accommodate customers with qualifying disabilities.
*According to federal law as found on https://www.ada.gov/taman3.html, places of lodging with 5 or less units and have the owner living on the property are exempt from having to have an ADA unit for those with disabilities. Religious organizations are exempt from title III requirements. Historical properties may also be exempt from certain aspects of title III requirements, but property owners need to verify based on local and federal requirements.
